FSA eligibility

unfortunately the Employer is willing to enroll me with a disclaimer that its their understanding that both parents need to be working to take advantage of the FSA benefit. They asked me to check the IRS regs to ensure i’m doing the right thing

 

Your employer is right, as that is absolutely true. However, that only applies to caregiver expenses. An FSA is more flexible than an HSA, in that an FSA account can be used to pay for daycare, as well as certain out-of-pocket health care costs. That does not include paying your wife to provide care to your elderly mother unfortunately. But if she was to be put in a home (which I’m sure is not the most desirable) then both you and your wife would have to work, in order for the care costs to be deductible through an FSA.
